Beyond consent, additional legal bases for the collection and processing of your Personal Information include: (i) where the Personal Information is necessary for the performance of a contract or the provision of a service you have requested; or (ii) where the collection and processing is in our legitimate interests or the legitimate interests of another party, provided that such interests are not overridden by your data protection rights or fundamental rights and freedoms. In certain instances, we may also be subject to a legal obligation that requires us to collect specific Personal Information. If we collect your Personal Information based on your consent, you retain the right to withdraw that consent at any time, as described in the jurisdiction-specific sections below.

If you reside or are physically located outside of the United States, you acknowledge and agree that we may: (i) collect, use, disclose, and otherwise process the Personal Information you provide, even if you are located in a jurisdiction outside the United States; and (ii) collect, use, maintain, store, disclose, and otherwise process your Personal Information using servers, systems, and infrastructure located within the United States.

3. PURPOSES FOR WHICH WE USE YOUR INFORMATION

We may use your Personal Information for the following general, operational, and business purposes:

We may employ both manual processes and automated systems, including machine learning algorithms and artificial intelligence technologies, to: analyze Personal Information and Anonymous Information in order to improve and optimize our Services; personalize and customize your experience; automate certain features and workflows within the Services; aggregate and anonymize data for statistical and analytical purposes; provide you with specific functionalities; and safeguard the safety, security, and integrity of our Services and users.

We use Anonymous Information — such as data regarding which web pages or mobile screens you have viewed — to analyze request patterns, usage trends, and behavioral data so that we may enhance our products and services, improve user experience, and compile broad demographic information for aggregate and statistical use.

4. HOW WE SHARE AND DISCLOSE INFORMATION

We do not sell, trade, rent, or share your Personal Information with third parties for their own independent marketing purposes. We will not disclose financial information that constitutes part of your Personal Information unless you specifically request or authorize us to do so.

i. Corporate Affiliates and Subsidiaries

We may disclose Personal Information to our corporate subsidiaries, parent companies, or affiliated entities that operate under the same or substantially similar internal processes and policies. Any Personal Information shared with our subsidiaries or affiliated entities will be handled and protected in accordance with the terms of this Privacy Policy.

ii. Third-Party Vendors and Service Providers

We may share your Personal Information with third-party vendors, suppliers, contractors, and service providers that assist us in operating, delivering, and improving the Services. These third parties provide services including but not limited to email delivery and distribution (such as for newsletter and alert distribution), data hosting and cloud infrastructure, customer relationship management, data analytics and reporting, and related technical and operational functions. You expressly consent to the sharing of your Personal Information with our contractors and third-party service providers solely for the purpose of providing products, services, and support to you. (This consent provision is not applicable to Canadian consumers.) All such service providers are contractually required to maintain the confidentiality of Personal Information and to implement appropriate technical and organizational security measures.

iii. Payment Processing Services

We use third-party payment processors to handle any purchases or transactions you may make through the Services. Please be advised that we do not have access to, and do not store, any Personal Information — including credit card numbers, bank account details, or other financial data — that you provide directly to these payment processors. This Privacy Policy does not govern and does not apply to third-party payment processors, and we do not accept any responsibility or liability for their privacy policies, practices, or data handling procedures. We encourage you to review the privacy policies of any third-party payment provider before completing any transaction.

iv. Partner Companies and Co-Branded Offerings

We may enter into co-branding, co-promotional, or joint marketing agreements with third parties ("Partner Companies") pursuant to which we may share certain Personal Information. For example, we may participate in arrangements where Partner Companies distribute and promote a co-branded URL or registration page to their respective customers. In such cases, a Partner Company may have access to Personal Information that we collect from individuals who register through their promotional channels. If you register for the Services through a Partner Company, we may provide your Personal Information to that Partner Company. We do not control the privacy practices of Partner Companies and encourage you to review their individual privacy policies before providing them with your information.

v. Legally Required and Safety-Related Disclosures

Under certain circumstances, we may be required or authorized by law to disclose your Personal Information, including:

vi. Aggregated and Anonymized Data

We may use your Personal Information to create non-personal, aggregated information ("Aggregate Information") that does not allow you to be identified or contacted and that is combined with the de-identified Personal Information of other users. For example, we might inform third parties about the total number of users of the Services, the geographic distribution of our users, or the types of activities conducted on the Services. Depending on the circumstances, we may or may not charge third parties for access to this Aggregate Information. We do not limit the manner in which third parties may use Aggregate Information.

We may disclose Anonymous Information to third parties that promote our products and services. We reserve the right to use and disclose Anonymous Information to third parties at our sole discretion and for any lawful purpose.

5. YOUR CHOICES: OPTING OUT OF PROMOTIONAL COMMUNICATIONS

When you receive promotional communications or newsletters from us, you may opt out by following the unsubscribe instructions included in the communication you receive. You may also opt out of receiving newsletters and promotional communications at any time by sending a request to contact@apex-alerts.com.

Please note that even if you opt out of marketing communications, we may continue to send you non-marketing, transactional, or administrative communications related to the Services, such as notices about administrative updates, transaction confirmations, security alerts, and changes to the Services, this Privacy Policy, or our Disclaimer. Where applicable, please refer to our Privacy Notice for additional details.

6. HOW LONG WE RETAIN YOUR DATA

We will retain your information for the period necessary to provide requested services, fulfill our legitimate business purposes, and comply with applicable law. We will retain Personal Information only for the longer of: (a) the period required by applicable law, or (b) a reasonable, time-bound period determined by a legitimate business need. When your Personal Information is no longer necessary for these purposes, we will take appropriate steps to securely delete, destroy, or anonymize it in accordance with our data management practices.

7. SAFEGUARDING YOUR INFORMATION

These measures include encryption protocols, access controls, secure data storage, and regular security assessments.

While we make diligent efforts to protect your information, no method of data transmission over the Internet and no method of electronic storage is completely secure. Consequently, we cannot guarantee or warrant the absolute security of any information you transmit to us, and you provide such information at your own risk. We cannot ensure that your information will remain secure under all circumstances, and we are not responsible for the circumvention of any privacy settings or security measures we may implement.

9. PRIVACY RIGHTS FOR EEA, UNITED KINGDOM, AND SWISS RESIDENTS

Legal Basis for Processing Personal Information

For residents of the European Economic Area (EEA), the United Kingdom, and Switzerland, please be aware that your Personal Information will be transferred to and processed in the United States, which has data protection laws that differ from those in your jurisdiction and may not provide an equivalent level of protection. The United States has not obtained a formal finding of "adequacy" from the European Union under Article 45 of the General Data Protection Regulation ("GDPR").

Our legal bases for collecting and using your Personal Information include: processing with your affirmative consent; where the Personal Information is necessary for the performance of a contract or the delivery of a service you have requested, including the provision of our newsletter and alert services; or where the collection and use is in our legitimate interests or those of a third party and is not overridden by your data protection interests, fundamental rights, or freedoms. In certain cases, we may also have a legal obligation to collect the Personal Information in question. If we collected your Personal Information with your consent, you may withdraw that consent at any time without penalty.

To exercise rights under the GDPR, UK GDPR, or Swiss data protection law, please direct your request to contact@apex-alerts.com.

Our retention of your Personal Information and any subsequent communications are grounded in our legitimate interest in providing you with new and potentially relevant materials based on your geographic location, professional role, or expressed interests. You may elect to opt out of receiving such communications at any time.

To the extent that we transfer Personal Information from the EEA, UK, or Switzerland to a jurisdiction outside the EEA, UK, or Switzerland that has not been recognized by the European Commission as providing adequate data protection (such as the United States), we will ensure that such Personal Information is safeguarded through appropriate contractual terms, standard contractual clauses, or other approved transfer mechanisms.

Your Rights Under GDPR and Applicable Law

If you are a resident of the EEA, United Kingdom, or Switzerland, you have the following rights with respect to your Personal Information:

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

If we ask you to provide Personal Information to comply with a legal requirement or enter into a contract, we will inform you of this at the time of collection and let you know whether providing your Personal Information is required and, if not, the consequences of not sharing your information with us.

Similarly, if we collect and use your Personal Information in reliance on our or a third party's legitimate interests and those interests are not already described in this Privacy Policy, we will inform you of what those legitimate interests are.

We endeavor to apply suitable safeguards to protect the privacy and security of your Personal Information and to use it only in a manner consistent with your relationship with us and the practices described in this Privacy Policy.

To withdraw consent or exercise any of these rights, please contact us via email at contact@apex-alerts.com.

If you are not satisfied with our response, or if you believe we are processing your Personal Information in violation of applicable law, you have the right to lodge a complaint with the relevant Supervisory Authority (also known as a Data Protection Authority) or other appropriate governmental authority in your EEA Member State, the United Kingdom, or Switzerland.

10. PRIVACY RIGHTS FOR CANADIAN RESIDENTS

If you reside in Canada, you have the right to request access to the Personal Information we hold about you and to request the correction of any Personal Information that is inaccurate or incomplete, subject to limited exceptions established under applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial legislation.

You may also withdraw your consent to the collection, use, and disclosure of your Personal Information at any time, subject to legal or contractual restrictions and reasonable notice. Please note that withdrawal of your consent may affect our ability to continue providing you with the Services, as the ongoing use and disclosure of your Personal Information may be a necessary component of making certain products or services available to you.

To exercise these rights, please contact us via email at contact@apex-alerts.com.

If you access the Services from a location outside the United States or engage in communications with us from abroad, please be aware that your Personal Information may be transferred to, stored in, and processed in the United States, where our servers and primary data infrastructure are located. Any information you provide to us, or that we collect through your use of the Services, may be stored, processed, and transferred within or to the United States.

Please be aware that the United States and other jurisdictions to which your data may be transferred may not provide the same level of data protection as the jurisdiction in which you are located or reside. Your Personal Information may be accessible to the United States Government or its agencies under lawful legal processes applicable in the United States.

We do not employ any application, mechanism, or technology to determine the age of users of the Services. All information submitted to Apex Alerts will be treated as if it was provided by an adult. If, however, we become aware that a child has submitted Personal Information to us without appropriate parental consent, we will take prompt steps to delete that information from our systems as soon as reasonably practicable.

The Services may contain links to and from websites, applications, or services operated by third parties, including our business partners, advertisers, and various service providers. If you follow a link to any third-party website or service, please be aware that such third parties maintain their own privacy policies and data handling practices, and that we do not accept any responsibility or liability for their policies, practices, or conduct. We strongly encourage you to review the privacy policy of each third-party website or service before submitting any Personal Information to them.

The inclusion of a link to any third-party website, service, or location is provided for your convenience only and does not constitute or imply our endorsement, recommendation, or approval of such website, service, or its contents. We have no control over, do not review, and cannot be held responsible for these third-party websites, services, or their content. The terms of this Privacy Policy do not extend to or apply to any third-party websites or services.

14. MODIFICATIONS AND UPDATES TO THIS PRIVACY POLICY

We reserve the right to modify, amend, or update this Privacy Policy from time to time by posting revisions on this page. If we make any significant or material changes to this Privacy Policy, we will make reasonable efforts to inform you when required by applicable law, such as by posting a prominent notice on our website or sending you a notification. Your continued use of the Services after any modifications to this Privacy Policy constitutes your acknowledgment and acceptance of the revised terms.
